After Porter’s death Friday night, Smith’s charges have been upgraded to murder, Bell said Saturday.

According to witnesses the altercation started with a verbal disagreement inside what is known as “Brother Jay’s Club,” Bell said. The two moved into the parking lot after threats were made, according to the chief.

Brookhaven Police Department officers were dispatched at 5:37 p.m. Friday to the scene, where they found Porter, 59, lying on the ground with at least one bullet wound. Smith, 63, was still in the parking lot when they arrived.

The case is still under investigation.
