Jail time, fines handed down

Five of 18 defendants sentenced Tuesday received jail time afterearlier pleading guilty in Lincoln County Circuit Court.

In unrelated cases, defendants facing an aggravated assaultcharge and a marijuana possession charge were each ordered to servesix years of their respective sentences by Judge Mike Smith.

In the aggravated assault case, Darrick Dale May, 25, of 1340Sammy Trail, was sentenced to eight years and ordered to serve thefirst six, with the last two suspended for five years probation. Hewas also ordered to pay a $3,000 fine, $3,000 to the Crime VictimsCompensation Fund and a total of $9,718 in restitution for victimDempsey Clark’s medical expenses.

“He caused some extensive injuries,” said Assistant DistrictAttorney Jerry Rushing about May’s incident.

In serious cases, Rushing said he always speaks with the victim.Clark was satisfied with the sentence, Rushing said. He indicatedno weapons were used, but the reason behind the assault was notknown.

“We don’t know the history behind the altercation,” Rushingsaid.

In another case that warranted jail time, Eddie L. Thompson, 25,of Jackson, was sentenced to 18 years and ordered to serve thefirst six years for unlawful possession of marijuana with intent todistribute. The last 12 years of the sentence are to be servedunder post release supervision.

Thompson was also ordered to pay a $10,000 fine, restitution andto obtain his GED and alcohol and drug treatment while in thecustody of the Mississippi Department of Corrections (MDOC).

Other sentences handed down Tuesday included:

* Willie James Henderson, 18, of 364 Highway 583 — burglary ofa dwelling. He was ordered to serve three years of an eight-yearsentence with the last five on probation. He was also to pay a$2,500 fine, $500 to the Crime Victims Compensation Fund and gethis GED and alcohol and drug treatment while in MDOC custody.

* Rodney Dewayne Rushing, 20, of 1921 Falvey Road — burglary ofa dwelling. He was ordered to serve four years of a nine-yearsentence, with the last five on probation. He was also ordered topay a $3,000 fine, $500 to the Crime Victims Compensation Fund,$137 restitution and to get his GED and alcohol and drug treatmentwhile in MDOC custody.

* Billy R. Bledsoe, 37, of 923 North Egypt Circle — two countsthird offense DUI. He was ordered to serve a full 365 days of athree-year sentence, with the last two suspended for five yearsprobation. He was also to pay a $4,000 fine, $1,000 to the CrimeVictims Compensation Fund and to get alcohol and drug treatmentwhile in MDOC custody.

* Timothy Bowman, 17, of 107 Brady Dr. — uttering forgery. Hewas sentenced to seven years and placed in the Regimented InmateDiscipline (RID) program to earn probation and a term at theRestitution Center. He was also to pay a $3,000 fine, $500 to theCrime Victims Compensation Fund and to get alcohol and drugtreatment during RID.

* Gary Wayne Sanders, 29, of 531 North Jackson St. — aggravatedassault. He was sentenced to seven years and placed in RID to earnprobation and a term at the Restitution Center. He was also to paya $3,000 fine, $500 to the Crime Victims Compensation Fund and toget alcohol and drug treatment during RID.

* Michael Smith, 24, of 4235 Highway 550, Union Church — sexualbattery. He was sentenced to six years, suspended for five yearsprobation. He was also ordered to pay a $2,500 fine, $500 to theCrime Victims Compensation Fund, full restitution to Medicaid,obtain his GED and alcohol and drug treatment and to perform 250hours of community service work with Outreach Ministries.

* Henry Earl Rawls Jr., 22, of 304 East Enterprise St. –failure to support minor children. He was sentenced to eight yearsand placed in RID and a term at the restitution center to earnprobation. He was also ordered to pay a $1,300 in back childsupport, a $1,500 fine and $250 to the Crime Victims CompensationFund.

* Lynda Wheat, 47, of 1898 Brumfield Road, Summit –embezzlement. She was sentenced seven years, suspended for fiveyears probation, and to pay a $2,500 fine and $500 to the CrimeVictims Compensation Fund. A condition of her plea agreement wasthat she pay approximately $19,000 in restitution before pleadingguilty last week.

* Jonathan Robert Hutt, 21, of Wesson — third offense DUI. Hewas sentenced to three years suspended for five years probation andplaced in the Intensive Supervision Program (ISP), or house arrest.He was also to pay a $4,000 fine, $500 to Crime VictimsCompensation Fund, get hid GED, alcohol and drug treatment and toattend AA meetings once a week for a year.

* Melissa R. Byrd, 30, of 3165 Highway 550 — third offense DUI.She was sentenced to three years suspended for five years probationand placed under house arrest. She was also to pay a $4,000 fine,$500 to Crime Victims Compensation Fund, get alcohol and drugtreatment, complete an anti-alcohol medication program and toattend AA meetings once a week for a year.

* Terrence Thompson, 31, of 5968 Good Loop Lane, Liberty — twocounts of uttering forgery. He was sentenced to seven years,suspended for five years probation. He was also to pay $70restitution, a $2,500, $500 to Crime Victims Compensation Fund anda term at the restitution center. His sentence is to run concurrentwith an Amite County charge.

* Tommy Kelly, 18, of 408 East Cherokee St. — unlawfulpossession of marijuana with intent to distribute. He was sentencedto two years and placed under house arrest. He was also ordered topay a $3,000 fine, to obtain alcohol and drug treatment, his GED,attend AA meetings once a week for a year and to perform 350 hoursof community service with Outreach Ministries.

* Anthony Guines, 27, of Highway 28, Hazlehurst — conspiracy todistribute marijuana. He was sentenced to two years, suspended forfive years probation. He was also to pay a $2,000 fine and $250 tothe Crime Victims Compensation Fund.

Three defendants were sentenced under a law allowing theirrecords to be cleared provided they meet certain conditions.

* Eric Cheyenne Coglan, 23, of 3765 Cole Dr. Bogue Chitto, andJay Dean Hux, 20, of 2818 New Sight Dr. — burglary of a business.They received three years probation, $2,000 fine, $500 each to theCrime Victims Compensation Fund, $639 restitution and each toperform 250 hours of community service with OutreachMinistries.

* Terry Demorest, 19, of Hazlehurst — uttering forgery. Hereceived three years probation and was ordered to pay a $1,000 fineand $250 to the Crime Victims Compensation Fund. He was also toobtain alcohol and drug treatment, his GED and to perform 250 hoursof community service work with Outreach Ministries.]

Two defendants pleaded guilty Tuesday are awaiting sentencing onNov. 3. They include:

* Maurio Terrell, 17, of Katey Trail — eight counts ofburglary.

* Corey Barlow, 24, of 2029 Byhalia Road, Wesson — possessionof marijuana with intent to distribute and conspiracy.

Pre-sentencing investigations to determine Terrell’s andBarlow’s criminal history must be done before they can besentenced.
