Court action begins for indicted suspects

Approximately half of the 58 people recently indicted by theLincoln County Grand Jury have been served with court papers andarraignment proceedings have begun, court officials said.

Those arraigned last week before Judge Keith Starrett have untilApril 17’s omnibus hearing date to decide if they will accept aplea agreement from the District Attorney’s Office. Otherwise, thepurpose of the omnibus hearing is to set a date and make sure bothsides are prepared to proceed to a trial.

“They’ll plead guilty with a (sentencing) recommendation orthey’ll plead blind after that date,” said Assistant DistrictAttorney Jerry Rushing. “If they don’t plead, they’ll go totrial.”

People who have been served with their indictments and theiralleged crimes include:

* Percy J. Henderson, 27, of 3137 James Dr., Wesson – Thirdoffense DUI.

* Kevinisha Henderson Brown, 20, of 300 Old Wesson Road – Twoindictments, one for two counts of burglary and another forpossession of stolen property.

An indictment represents only a belief by the grand jury thatthere is probable cause to suspect a crime has been committed, andit is not a statement on the defendant’s guilt or innocence.

Indictments are not public record until those accused have beenserved with the court papers.

Lincoln County Sheriff Lynn Boyte indicated a number of theoutstanding indictments were for felonious bad checks. He saiddefendants in those cases are sometimes difficult to locate due tofalse information, their movement away from the area and otherreasons.

“We make every effort to contact all of these folks,” Boytesaid.
