One sentenced; some waive hearings

Lincoln County Circuit Court officials had a busy but uneventfulday Monday as defendants faced arraignment proceedings followingtheir recent indictments.

“It was a lot of people, but it was just ordinary courtmatters,” said Circuit Clerk Terry Lynn Watkins.

After pleading guilty in November to attempting to obtainoxycodone, Gary Boutwell Jr., 37, whose last known address is 405Pine Dr., was placed on five years non-adjudicated probation. Thenon-adjudicated status means his record will be cleared provided hemeets the terms of his probation.

Boutwell was also ordered to pay a $3,000 fine, restitution andto continue attending Alcoholics Anonymous meetings.

Other defendants appearing in court Monday waived theirarraignments, in effect pleading innocent, and signaling that theyare ready to proceed to trial. They may accept a plea agreementfrom the District Attorney’s Office prior to their omnibushearings, when motion and other preliminary trial matters arehandled.

“They’re set of omnibus on Jan. 30 at 9 a.m.,” Watkins said.

Defendants waiving arraignment and their charges included:

* Christopher Charles Young, 25, of 528 Eastgate – unlawfulpossession of marijuana with intent to distribute.

* Larry Richardson, 57, of 963 Southwest Pecan Dr., Bogue Chitto- unlawful possession of cocaine.

* Bessie Marie Brothern, 63, of 103 Weems St. – unlawful sale ofcocaine within 1,000 feet of a public park and unlawful possessionof cocaine with intent to distribute.

* Zachary Barrett Davis, 20, of 913 Hog Chain Road, Bogue Chitto- two indictments for unlawful sale of meperidine and one forunlawful sale of marijuana.

* John Joseph Busby, 19, of 1933 Busby Trail – unlawful sale ofmarijuana.

* Anton Hoeniges, 27, of 705 West Chickasaw St. – unlawfulpossession of marijuana with intent to distribute within 1,500 feetof a church.

* Jorge Excalera, 38, of Lawrence, Maine – unlawful possessionof more than one kilogram of cocaine with intent to distribute.

* Jorge Amaro Davila, 48, of West Chicago, Ill. – two counts ofaggravated assault on a law enforcement officer.

* Johnny R. Hood, 23, of 823 West Congress St. – grand larcenyand conspiracy.

* William L. Hutson, 18, of 1965 New Sight Dr. – grand larcenyand conspiracy.

* Matthew G. Ward, 33, of Muskogee, Okla. – burglary of adwelling.

* Willie Quarles, 20, of 203 Fulton St. – aggravatedassault.

* Amie J. Gayten, 43, of 311 Chestnutt Lane, Bogue Chitto -simple assault.

* James “Paz” Hux, 55, of 313 Old Wesson Road – three counts offalse pretense and possession of a firearm by a convictedfelon.

* Tony L. Freeman, 43, of 447 North Hamilton St. – seven countsof fraudulent use of a credit card.

* Roger Eugene Thomas, 37, of 901 Park Lane Dr. – twoindictments, one for embezzlement and one for felony badchecks.

* Dennis Ray Jordan, 55, of 3094 Jordan Dr., Smithdale -unlawful possession of cocaine with intent to distribute.

In other court action, Raymond Keith Thomas, 26, of 2276 OldHighway 51, Wesson, pleaded not guilty after being formallyarraigned on an armed robbery charge. Also, a Jan. 26 trial datewas set for Kimberly L. Phillips, 27, of 242 Marr St., who has beencharged with embezzlement.

Judge Mike Smith presided over Monday’s court activity.
