Supervisors mull court duties amid judge suspension

Lincoln County supervisors are continuing to determine how courtduties will be handled during a court judge’s upcomingsuspension.

During Monday’s board meeting, supervisors briefly discussed PostOne Justice Court Judge Ralph Boone’s looming 90-day suspension andwhether a judge will have to be appointed to handle his dutiesduring that time.

“I can’t find an (Attorney General’s) opinion that says you’rerequired to,” said board attorney Bob Allen told supervisors.

On April 28, the state Supreme Court ordered Boone suspended for 90days without pay following some inappropriate contact with adefendant before his court in 2009. The high court did not orderBoone removed from office, as was recommended by the stateCommission on Judicial Performance, but did order the suspension,payment of court costs and a public reprimand.

Boone’s suspension has not started, Allen said. There is a 20-daywindow for Boone to appeal, but the timetable for that action wasnot clear Monday.

Supervisors took no action on the matter Monday as Allen said hewould look to determine when the suspension would start. Theattorney also said he would speak with Post Two Justice Court JudgeAnn Reeves about the situation.

If needed, Allen recommended the board appoint a justice courtjudge or a municipal court judge from an adjoining county to handlethe caseload. Allen said Monticello Municipal Court Judge RogerArnold had expressed an interest in an appointed position.
