Attorneys for a former bus driver accused of a sex crime filed a motion Wednesday to suppress statements made at the Lincoln County Sheriff’s Department. The defense said in the motion that Charles Davis, 68, of 660 Alderman Lane, was not advised that he was a suspect of a crime, was not advised of his right to remain silent and was not advised of his right to counsel.
Davis’ indictment, issued on Nov. 20, alleges that on or about Sept. 19 Davis touched a child under 16, “for the purpose of gratifying his lust or indulging his depraved licentious sexual desires.”
Davis, who drove a route for West Lincoln Attendance Center, was arrested Sept. 25. Lincoln County Sheriff Steve Rushing said the victim’s parents reported an alleged incident on Sept. 18. Per a recommendation from the District Attorney’s Office, charges were filed and a warrant was issued.
Davis pleaded not guilty, and his trial is currently scheduled for June 7. He was released on a $25,000 bond.
Moncherik K. Hooks
Also scheduled for a June 7 trial is Moncherik Hooks. Hooks was indicted for touching and handling a child for lustful purposes on July 15. Hooks’s trail was initially set for Feb. 8, but the defense filed a motion to continue because the attorney had previously scheduled trials.
Hooks was released April 22, 2015 on a $25,000 bond.
Daffine Martin
Daffine Martin, charged with conspiracy and armed robbery, is also scheduled for trial on June 7. His indictment alleges that he and Phillip D. McNulty stole cash from Auburn One Stop Grocery on or about April 17, 2015 after brandishing a tire iron or firearm.
The indictment alleges that McNulty had a Cobra .380 handgun in his possession on the day of the crime.
McNulty pleaded guilty to similar crimes in 2006.
