BRANDON (AP) — A man says he’s suing Bank of America, claiming the mortgage lender had agents unlawfully break in to inspect his Mississippi home without advance notice while he was in California caring for his gravely ill wife.

The Clarion Ledger cites George Huggins Jr. in a Tuesday report as saying his wife primarily paid the mortgage and the debt apparently became delinquent.

Huggins says she died in May and when he returned to his Brandon home in July, he found the locks were changed. He says Safeguard Properties Management acknowledged it sent agents on the bank’s behalf.

Safeguard nor the bank have filed answers to Huggins’ suit that seeks damages. But Safeguard filed a motion that moved the case last week to federal court in Jackson.

A U.S. magistrate judge has scheduled a February telephone conference.
