OXFORD (AP) — A trial has been delayed for a retired Mississippi sheriff’s deputy accused of tampering with evidence after he shot a man to death in 2013.

Senior U.S. District Judge Neal Biggers earlier this month delayed Walter Grant’s trial after both prosecutors and defense attorneys filed motions for Grant to undergo a psychiatric exam.

Then a Bolivar County deputy, Grant is accused of planting a baton after shooting 20-year-old Willie Bingham Jr. near Cleveland. Prosecutors say Grant sought to make it appear that Bingham was armed.

Grant was indicted in 2015 on state manslaughter charges. He’s been tried twice on those charges, and both times jurors couldn’t reach a unanimous verdict.

Grant has pleaded not guilty and is free on $10,000 bail.
