FedEx shooting trial back on the docket

BROOKHAVEN — Judge David Strong’s Lincoln County Court Docket shows Gregory Case and Brandon Case, each charged with attempted murder and conspiracy to murder, shooting into a motor vehicle, are back on the docket. Strong declared a mistrial in their court case in August 2023 due to a court rule being violated. 

The Cases were arrested in February 2022 after shooting at FedEx driver D’Monterrio Gibson on Jan. 24, 2022. After going through grand jury, pretrial motions and two days of court the FedEx shooting case was declared a mistrial because Brookhaven Police Detective Vincent Fernando introduced surprise evidence. At the time, District Attorney Dee Bates said he and the defense had asked for all discovery to be submitted ahead of the trial. 

Gibson was later fired by FedEx. He filed a lawsuit against Brookhaven, the Cases and others for $5 million.
