Re-trial denied for convicted killer

In a hearing in Lincoln County Circuit Court Monday, Fred Hill III’s requests for retrial and acquittal were denied.

This follows a cease-and-desist order issued to Hill and his defense Thursday for unsolicited contact with jurors.

On Feb. 17, Fred Hill III, 25, was convicted for the April 2, 2015, murder of Timothy Green, 31, and sentenced to life in prison. He was also given five years each for shooting into a dwelling and possession of a firearm by a convicted felon.

Lincoln County Sheriff Steve Rushing said the call came in at 1:50 a.m. on April 2 that a subject had been shot on Spur Lane. When the sheriff’s department and ambulance arrived on the scene, Green was found dead.

In documents filed with the court, Hill sought a new trial because he “renewed his pretrial objections to the admissibility of his statements to investigators, as well as evidence obtained during a warrantless search of his wife’s vehicle. The suppression motions were denied and the renewed objections were overruled at trial.”

He also claimed that testimony of “alleged eyewitnesses was severely discredited.”

Fred Hill Jr., his father, was indicted Nov. 20 for tampering with a witness in relation to the case.
