A mistrial has been declared in the case of father and son Gregory and Brandon Case, charged with attempted murder for shooting at FedEx driver D’Monterrio Gibson.

Judge David Strong declared the mistrial just minutes into Day 3 of the trial in Brookhaven.

On Thursday, defense attorneys said a key witness in the case, Brookhaven Police Detective Vincent Fernando, violated multiple rules on the witness stand. He withheld evidence and blurted out statements excluded in the trial, attorneys told Judge Strong, asking for a mistrial.

Gibson’s attorneys disagreed, arguing a mistrial was not necessary, but Strong said he “had no other choice.”
