FedEx driver civil cases vs. Brookhaven are no more

The civil case filed by a former FedEx driver against the City of Brookhaven and its officials is no more, and no additional claims can be filed.
In January 2022, D’Monterrio Gibson was making deliveries for the company in a Hertz rental van in Brookhaven. According to court records, Gibson had delivered a package to a home when resident Brandon Case blocked the vehicle in the roadway with his own truck. He did so reportedly because the van was in front of the unoccupied home of Gregory Case’s mother-in-law.
Shots were fired by the white men as the black FedEx employee drove around and away from the vehicle, striking the van but not injuring Gibson.
A $5 million civil lawsuit from Gibson against the City of Brookhaven, FedEx, Brookhaven Police Chief Kenneth Collins, and the Cases, was dismissed by a federal judge in late 2023. A second civil suit was filed in November solely against FedEx after the company fired him.
He was terminated via email, Gibson told the Associated Press, just days after a mistrial was declared in Lincoln County Circuit Court in the criminal case against father and son Brandon and Gregory Case. The men were accused of attempted murder, conspiracy, and shooting into a motor vehicle. Their cases remain on the trial docket as needed to be rescheduled.
No additional claims were filed in Mississippi at the state level prior to the end of the statute of limitations, attorney Bobby Moak told the Brookhaven Board of Aldermen Tuesday. No more claims may therefore be filed in the matter against the city.
