An Oct. 20 trail date was set in a Wednesday hearing for a man accused of firing at a law enforcement officer on July 11, 2014.

Chance Nicholas Smith, 23, of 1311 Adolf Lane, was arrested on July 12, 2014, for resisting arrest and aggravated assault on a law enforcement officer.

The indictment issued March 24, 2015, alleges that Smith shot at Marzell Brooks, a law enforcement officer with the Brookhaven Police Department.

According to a Daily Leader report published the same day, a complainant alleged that Smith, who was with Darrius Mitchell, fired a gun at him.

Police Chief Bobby Bell said at the time that police attempted to stop Smith and Mitchell after they drove by, and chased them to Center Street where one of the suspects exited the vehicle and shot at the officer.

On April 18, Circuit Court District 14 judges Michael M. Taylor and David H. Strong both recused themselves from the case. Senior Status Judge L. Breland Hilburn was appointed by the Mississippi Supreme Court on April 25 to preside over the case.

Smith is currently serving 20 years in prison after he pleaded guilty to manslaughter in Forrest County on Dec. 15. He was transported from Mississippi Department of Corrections custody to the Lincoln County jail Aug. 25.
